2. Scope of Application

These General Terms and Conditions of Sale (hereinafter “T&Cs”) govern all purchases made through the website bodyfurnitures.com (hereinafter “Website”) by any customer, regardless of nationality or country of residence (hereinafter “Customer”).

Purchasing products through the Website implies full acceptance of these T&Cs as in force at the time of the order. Bodyfurnitures reserves the right to amend these T&Cs at any time; such amendments will not apply retroactively to orders already confirmed.

The contract of sale is deemed concluded in Italy, at Bolzano. The contractual language is Italian; English and German versions are provided for information purposes only.


3. Products and Availability

Bodyfurnitures offers artist jewellery entirely handcrafted by Gian Luca Bartellone, using materials including papier-mâché, precious metals and natural gemstones. The range is divided into two main categories:

3.1 Author Jewelry – One-of-a-Kind Pieces

Jewellery in the “Author Jewelry” section consists of unique, one-of-a-kind pieces, individually designed and made by the artist. Bodyfurnitures applies the strictest possible interpretation of uniqueness: each piece exists as a single specimen in the world.

This uniqueness is a formal guarantee to the Customer: no other person will ever wear an identical piece. Once sold, a piece is never reproduced, even upon explicit request from third parties. Bodyfurnitures does not accept commissions aimed at faithfully replicating a work already created and sold under the Author Jewelry section.

Purchasing an Author Jewelry piece is therefore the acquisition of an unrepeatable wearable work of art — in its form, its materials and its history.

3.2 Collections – Limited Editions

Jewellery in the “Collections” section consists of limited editions: each model is produced in a small number of pieces. Due to the handcrafted nature of production, minor variations may occur between individual specimens of the same model. Please refer to Article 4 for details on images and product representation.

Product availability is indicated on the Website at the time of visiting; however, it may change. Bodyfurnitures reserves the right not to accept an order if the product is sold out or unavailable. In such cases, the Customer will be promptly informed and will receive a full refund of any amount already paid.


4. Product Images and Representation

Bodyfurnitures strives to provide photographs and descriptions of its products in the most faithful and accurate way possible. However, given the inherently handcrafted and artistic nature of each piece, images on the Website should be understood as reference representations and cannot, in themselves, constitute the sole parameter for evaluating the purchased product.

4.1 Author Jewelry – Exact Correspondence

For jewellery in the “Author Jewelry” category, each image published on the Website depicts the specific, unique piece being offered for sale. The jewellery delivered corresponds exactly to the photographed piece, as it is an unrepeatable work. The Customer is entitled to expect faithful correspondence between the product received and the images displayed.

4.2 Collections – Variations within the Limited Edition

For jewellery in the “Collections” category, photographs depict a representative specimen of the series. Due to the handcrafted process, minor differences may occur between the published image and the piece actually delivered. Such variations are to be considered positive distinguishing features of artisanal craftsmanship, and do not constitute defects or non-conformity.

Possible variations include in particular:

  • differences in texture, tone or surface finish due to the natural characteristics of papier-mâché and its drying process;
  • minor irregularities in the metal, such as variations in sheen or colour nuances, typical of handwork;
  • differences in the visual characteristics of natural and precious gemstones (clarity, inclusions, chromatic tone, dimensions), as these are materials of natural origin whose variability is intrinsic and uncontrollable;
  • imperceptible asymmetries resulting from hand production.

Note: Bodyfurnitures ensures that such variations are always minimal and fully consistent with the quality and artistic integrity of the product. Customers wishing to obtain specific information about a piece prior to purchase are invited to contact the seller directly.

4.3 Colour Rendering and Devices

The chromatic rendering of images may vary depending on the settings of the monitor, screen or device used by the Customer. Bodyfurnitures is not responsible for any colour differences perceived by the Customer and attributable to such technical factors.


5. Prices and Tax Regime

All prices shown on the Website are expressed in Euros (€). Bodyfurnitures operates under the Italian flat-rate tax scheme (regime forfettario, Law 190/2014): under this regime, Italian VAT is not applied or charged on sales. Prices shown are therefore final prices, VAT-exempt.

5.1 VAT-Exempt Prices

Bodyfurnitures operates under the flat-rate tax scheme: prices shown on the Website are final prices, exempt from VAT. No value added tax — Italian or from the Customer’s country — is charged on purchases made through the Website. For Customers outside the EU, please refer to Article 5.2 for any local taxes that may apply upon import.

5.2 Customers outside the European Union – Local Import Taxes

For shipments to countries outside the European Union, in addition to any customs duties (see Article 9), the fiscal authorities of the destination country may apply local import taxes, such as:

  • VAT or equivalent tax (e.g. GST in Australia/Canada, VAT in the United Kingdom, GST/HST/PST in Canada, etc.);
  • Sales tax (in the United States, varying by state);
  • other indirect taxes provided for by local legislation.

Such taxes are entirely at the Customer’s expense and are normally collected directly by customs or the carrier upon delivery. They are not included in the price shown on the Website or in shipping costs. Bodyfurnitures is not in a position to predict their amount, which depends solely on the legislation of the destination country.

5.3 Price Changes

Bodyfurnitures reserves the right to change prices at any time. The price applicable to an order is that shown on the Website at the time the Customer confirms the order. Shipping costs are shown separately at checkout.


6. Payment Methods

The Website accepts the following payment methods:

  • credit / debit card (Visa, Mastercard, American Express);
  • PayPal;
  • Stripe (secure payment with SSL encryption);
  • bank transfer (instructions provided at checkout; the order is processed upon receipt of payment);
  • additional methods as indicated on the Website at the time of ordering.

Payment is processed upon order confirmation. Bodyfurnitures takes all reasonable technical measures to ensure transaction security, but cannot be held responsible for any unauthorised access by third parties in the absence of its own negligence.

The Customer declares that they are the holder of the payment method used, or that they have been expressly authorised to use it by its holder.


7. Contract Formation

The purchasing process is as follows:

  • the Customer selects the desired products and adds them to the basket;
  • at checkout, the Customer provides shipping and payment details;
  • by confirming the order, the Customer submits a binding purchase proposal;
  • Bodyfurnitures sends an initial order receipt email: this communication does not constitute acceptance of the contract, but simple confirmation of receipt;
  • the contract is concluded when Bodyfurnitures sends a second shipping confirmation email. The contract is concluded in Italy, at Bolzano.

Bodyfurnitures reserves the right to refuse or cancel an order in the event of: product unavailability, pricing errors on the Website, payment verification issues, or any other justified reason. In such cases, the Customer will be promptly notified and will receive a full refund of any amounts already charged.

In order to guarantee the security of transactions and protect all its customers, Bodyfurnitures also reserves the right not to process orders that present technical anomalies, inconsistencies in the data provided, or indications of potential fraudulent use of payment methods. In such circumstances, Bodyfurnitures may contact the Customer to request identity verification before proceeding with dispatch, or proceed to cancel the order with a full refund of any amount already charged.


8. Shipping and Delivery

8.1 Destination Countries

Bodyfurnitures ships exclusively to countries listed in the “Client Care” section of the Website. Before placing an order, Customers are invited to verify that their destination country is included in the updated list. Bodyfurnitures reserves the right to update the list of reachable countries without prior notice.

8.2 Preparation and Dispatch Times

Except in cases of force majeure or public holidays, available products are prepared and handed to the carrier within 24 working hours of receiving order confirmation (or of receiving payment, in the case of bank transfer). Italian national holidays and non-working days are excluded from the calculation.

Upon dispatch, the Customer receives an email with a tracking number to monitor the delivery status.

8.3 Estimated Delivery Times

Estimated delivery times by destination zone are indicated in the “Client Care” section of the Website, where they are kept updated. Times shown run from the date of dispatch, are expressed in working days, and are indicative only: they may vary depending on the carrier, specific destination and customs procedures, for which Bodyfurnitures is not responsible.

8.4 Transfer of Risk

Responsibility for purchased goods passes to the Customer upon delivery and signature of receipt. Where a third party indicated by the Customer as recipient signs for the delivery, that party’s signature constitutes proof of delivery. Bodyfurnitures provides adequate insurance coverage during transit, up to delivery at the address indicated by the Customer.


9. Customs Duties and Import Taxes

For shipments outside the European Union, customs duties, import taxes or other fiscal charges may be applied by the authorities of the destination country. Such costs are entirely at the Customer’s expense, regardless of their amount, and are not included in the price shown on the Website or in the shipping costs.

9.1 Indicative Information

Bodyfurnitures publishes indicative information on duties and local taxes applicable in the main destination countries in the “Client Care” section of the Website. This information is provided for guidance only, based on the regulations in force at the time of publication.

The customs and tax regulations of individual countries may change at any time, often without notice and independently of Bodyfurnitures’ will or knowledge. Bodyfurnitures does not guarantee the continuous updating of this information and accepts no liability for any discrepancies between the published data and the charges actually applied by the authorities of the destination country.

The Customer is therefore responsible for independently verifying, with the competent authorities in their country, the customs duties and taxes currently in force before placing an order.

9.2 Application in the Event of a Return

In the event that the Customer exercises the right of return (see Article 10) and the return shipment incurs additional customs duties or import taxes (e.g. for re-entry of the goods into Italy), such costs are equally at the Customer’s expense. If Bodyfurnitures should advance such amounts in order to receive the return, it will deduct them from the refund amount due to the Customer.

Note: Bodyfurnitures completes customs documentation accurately and in compliance with applicable regulations. It is not possible to declare values below the actual amount or to classify products inaccurately, even upon the Customer’s request.


10. Right of Return and Refund

10.1 Extension of the Right of Return to All Customers

Bodyfurnitures grants all its Customers, regardless of their country of residence or citizenship, the right of return within 14 (fourteen) calendar days from the date of receipt of the product. This right is guaranteed on a voluntary basis also to Customers not resident in the European Union, for whom Italian consumer withdrawal legislation would not otherwise be compulsorily applicable.

For Customers resident in the European Union, this article complies with the provisions of Legislative Decree 206/2005 (Consumer Code), as amended by Legislative Decree 21/2014 implementing Directive 2011/83/EU, and guarantees at least the minimum protections provided therein.

10.2 How to Exercise the Right of Return

To exercise the right of return, the Customer must:

  • send a written communication to info@bodyfurnitures.com within 14 days of receipt of the product, stating the order number, the product to be returned and the reason for the return;
  • receive return shipping instructions from customer service;
  • dispatch the product within 14 days of the date on which they communicated their decision to return.

10.3 Conditions of the Product for Return

To be accepted, the returned product must be:

  • intact, unused and in perfect condition;
  • in its original packaging, complete with all accessories, certificates and documentation included;
  • free from signs of use, damage, modifications or alterations of any kind.

Bodyfurnitures reserves the right to refuse the return or to reduce the refund if the product shows damage attributable to improper use by the Customer.

10.4 Return Shipping Costs

Return shipping costs are in all cases at the Customer’s expense. Bodyfurnitures does not provide prepaid return labels, unless otherwise indicated in writing. The Customer is responsible for choosing an appropriate carrier and for insuring the return shipment.

The original shipping costs (already incurred for delivery to the Customer) are also non-refundable, unless the return is due to a product defect or an error attributable to Bodyfurnitures.

10.5 Refund

Following receipt and verification of the integrity of the returned product, Bodyfurnitures will refund the purchase price of the product (excluding original shipping costs) within 14 working days, using the same payment method used by the Customer for the purchase, unless otherwise agreed.

The refund may be reduced or suspended if the product is found to be damaged, incomplete or not compliant with the return conditions, or if customs duties advanced by Bodyfurnitures need to be deducted (see Article 9).


11. Customised Jewellery – Exclusion from the Right of Return

Bodyfurnitures does not currently offer customised jewellery in its online catalogue. However, should individual agreements be entered into for the creation of bespoke or customised pieces at the Customer’s specific request (e.g. engravings, particular sizes, materials chosen by the Customer), such products are expressly excluded from the right of return under Article 10.

This exclusion is in compliance with Article 59, paragraph 1, letter c) of Legislative Decree 206/2005, which provides for the non-applicability of the right of withdrawal for contracts for the supply of goods made to measure or clearly personalised. The Customer will be expressly informed of this exclusion prior to confirmation of the customised order.


12. Legal Guarantee of Conformity

Bodyfurnitures guarantees its products against conformity defects in accordance with the provisions of Legislative Decree 206/2005 (Articles 128–135), as amended by Legislative Decree 170/2021 implementing EU Directive 2019/771.

12.1 Customers resident in the European Union

For Customers resident in the European Union, the legal guarantee of conformity lasts for two years from the date of delivery of the product. This right is mandatory under law and cannot be limited or excluded by contract. In the event of a conformity defect discovered within the guarantee period, the Customer is entitled, at their choice, to repair or replacement of the product, or — where such remedies are not possible or proportionate — to a price reduction or cancellation of the contract with a refund.

12.2 Customers outside the European Union

For Customers not resident in the EU, Italian legal guarantee provisions are not mandatorily applicable. However, Bodyfurnitures voluntarily extends to all its Customers a conformity guarantee of 12 (twelve) months from the date of delivery, under the same conditions as above.

12.3 Exclusions from the Guarantee

The following are expressly excluded from the guarantee:

  • defects arising from normal wear and tear over time;
  • damage caused by improper use, accidents, impacts or inadequate maintenance;
  • natural variations in the characteristics of materials (gemstones, metals, papier-mâché) that fall within the tolerances described in Article 4;
  • damage resulting from contact with water, sea water or prolonged humid environments;
  • damage resulting from contact with chemical substances, acids or aggressive detergents;
  • damage resulting from contact with perfumes, cosmetics, sun creams or hairspray;
  • damage from prolonged exposure to heat sources or intense direct sunlight.

To report a defect, the Customer must contact Bodyfurnitures within a reasonable time of its discovery, sending written communication with photographs of the defect found.


13. Limitation of Liability

Bodyfurnitures shall not be held liable for indirect damages, consequential damages or loss of profit arising from the purchase or use of products, to the extent permitted by applicable law.

Bodyfurnitures’ liability for any claim shall in no case exceed the value of the purchased product that is the subject of the claim.

Bodyfurnitures is not responsible for delays or non-performance resulting from force majeure events (natural events, strikes, pandemics, government restrictions, etc.).


14. Intellectual Property

All content on the Website — including, without limitation, texts, photographs, images, videos, logos, designs and product descriptions — is the exclusive property of Bodyfurnitures and/or Gian Luca Bartellone, and is protected by Italian and international copyright and intellectual property law.

Any reproduction, distribution, modification or use of Website content without prior written authorisation from Bodyfurnitures is prohibited.


15. Personal Data Protection

The processing of Customers’ personal data is governed by the Bodyfurnitures Privacy Policy, available on the Website. Purchasing implies acknowledgement of the Privacy Policy. Personal data is processed solely for purposes related to order management, shipping, customer service and, with explicit consent, for marketing purposes.

15.1 Applicable Legislation – GDPR

Data processing is carried out in compliance with Regulation (EU) 2016/679 (GDPR) and Legislative Decree 196/2003 as amended by Legislative Decree 101/2018. Customers resident in the EU enjoy the rights of access, rectification, erasure, portability and objection to processing, exercisable through the methods indicated in the Privacy Policy.

15.2 International Privacy Regulations

International personal data protection regulations applicable in specific countries — including, by way of example, the CCPA (California Consumer Privacy Act, USA), LGPD (Lei Geral de Proteção de Dados, Brazil), FADP (Federal Act on Data Protection, Switzerland), PECR (Privacy and Electronic Communications Regulations, United Kingdom) and PIPL (Personal Information Protection Law, China) — govern the processing of personal data and do not directly affect these General Terms and Conditions of Sale.

Any obligations arising from such regulations towards Customers resident in the respective countries are addressed entirely in the Bodyfurnitures Privacy Policy, which is the reference document for all aspects relating to personal data protection. In the event of conflict between these T&Cs and the Privacy Policy on matters of personal data, the Privacy Policy shall prevail.


16. Governing Law and Jurisdiction

These T&Cs are governed by Italian law. Court of jurisdiction: Court of Bolzano (Italy), without prejudice to mandatory provisions of law.

For Customers resident in the European Union, it is possible to resort to the online dispute resolution platform (ODR) provided by the European Commission at: https://ec.europa.eu/consumers/odr.


17. Final Provisions

Should one or more clauses of these T&Cs prove invalid or ineffective, the remaining provisions shall remain in force to the maximum extent permitted by law.

Bodyfurnitures’ failure to enforce a right in a particular circumstance does not constitute a permanent waiver of that right.

These T&Cs may be updated periodically. The version applicable to each order is that in force on the date of order confirmation. Customers are recommended to keep a copy.
